The Sherwin-Williams Company Sherwin Williams is the largest manufacturer of paint products in the U. S. It is the most famous painting company in the United States. The Company owns more than 34 factories and 3,200 of their own branded stores, that is why it is considered the largest chain stores in the world of colors. The American company Sherwin-Williams was founded in 1866. Since its establishment, the company made a bid for new technology and innovation. 11 years after its founding in 1877, Sherwin-Williams Company has produced a revolution in the coatings industry, it has patented the manufacture of paint in an airtight jar. Since then the company is a leader in the development of new high-quality coatings based on the latest technologies and unique designs (Sherwin-Williams, 2011). Today, the Company Sherwin-Williams is the largest manufacturer of paint products in the U. Sherwin Williams Paints, known as ones of the highest quality, and therefore they are used for painting historic buildings and landmark buildings. The superiority of Sherwin Williams, among other companies is leadership of its paints in the global market thanks to new technologies, environmental production and exclusive content. Sherwin Williams Company’s products meet the highest standards, and especially the line with the brand GreenSure (Hoffman et al. 2010). There are the main features of paints of the company Sherwin Williams. Firstly, paints of this company are not sprayed. Secondly, when applying them to the surface they create smooth surface in the drying process. This is especially evident in comparison with the PVA-based paint or acrylic paint. Thirdly, paints of the company Sherwin Williams are aesthetic and efficient to use. Many of the Sherwin Williams paints can cover the surface with a single fold. This is due to different kinds of primers for different surfaces. The density of the substrate depends on both the paint and the shade. Therefore, Sherwin Williams paints save costs. At the present stage one of the main types of financial risks of the enterprise include (Adam, 2008): †¢ Risk reduction of financial stability. This risk is generated by imperfections in the capital structure, generating an imbalance of positive and negative cash flows of the company by volume. As part of the financial risks of the hazard (generated by the threat of bankruptcy), this risk has played a leading role. †¢ The risk of insolvency of the company. This risk reduction is generated by the liquidity of current assets, generating an imbalance of positive and negative cash flows of the company over time. In terms of financial impact this risk is also one of the most dangerous. †¢ Investment risk. It characterizes the possibility of financial losses in the investment activities of the enterprise. †¢ Inflation risk. In an inflationary economy, it stands out as a separate type of financial risks. This type of risk is characterized by the possibility of depreciation of the real cost of capital (in the form of financial assets of the enterprise) as well as the expected income from financial transactions in an inflationary environment. This type of risk under current conditions is permanent and is accompanied by virtually all financial enterprises. Interest rate risk. It is an unexpected change in interest rates in financial markets (both deposit and lending). The cause of this type of financial risk is the change in financial market conditions under the impact of government regulation, growth or decline offers of free cash resources and other factors. Negative financial conseque nces of this type of risk can be observed in the emission of the company in its dividend policy, in short-term investments and other financial transactions. †¢ The credit risk. It takes place in the financial activities of the enterprise in the provision of commodity or consumer loan customers. Its forms is a risk of nonpayment or late payment for a loan now tempered finished products, as well as the excess of the estimated budget for debt collection. †¢ Tax risk. This kind of financial risk has several implications: the likelihood of introducing new types of taxes and duties to carry out certain aspects of economic activity, the ability to increase the rates of existing taxes and fees; change the terms and conditions of certain tax payments, the probability abolish existing tax breaks in the field of business enterprise. It has a significant impact on financial performance. †¢ Structural risk. This type of risk is generated by inefficient financing the current costs of the enterprise that contributes to the high proportion of fixed costs in their total amount. High operating leverage ratio under adverse conditions of the commodity market developments and lower gross positive cash flow from operating activities generated a significantly higher rate of decline in the amount of net cash flow for this activity (Sandhusen, 2000; Lasher, 2010). Sherwin-Williams uses long-term debts that directly impact its bonds rating. This estimation has a significant role for the company’s development since it reflects the position of the company in the market. Wh en it comes to navigation, however, the Europeans were far ahead, allowing them to discover new territories, open new trade partnership and colonize new lands. Another difference between the Chinese and European expeditions is the unified Chinese efforts. In European scenario, several countries were vying for territories and there was no single ruler directing the efforts of discovery. There were hundreds of principalities seeking for support. Meanwhile China was more centralized because it was the Ming emperor who directed and funded the expeditions. It is important to note, however, that Asia as a continent was not unified – there were no single rulers and tribes warred against each other. In both Ming China and 15th century Europe, external threats were abundant. Philippine Psychology Act of 2009 Essay STATEMENT OF POLICY Section 2. Statement of Policy. The State recognizes that psychologists have an important role in nation-building and development. It also acknowledges the diverse specializations of psychologists and the diverse functions specific to the varied specializations. It particular, it recognizes the significance of the psychological services that practicing psychologists provide to diverse types of clients, but also recognizes the need to protect the public by preventing inexperienced or untrained individuals from offering psychological services. Hence, it shall nurture competent, upright and assiduous psychologists whose standards of practice and service shall be excellent and globally competitive through the administration of inviolable, effective and credible licensure examinations and the imposition and promotion of regulatory measures, programs and activities that enhance their professional growth and well-being. ARTICLE III DEFINITION OF TERMS Section 3. Definition of Terms. As used in this Act, the following terms shall have the following meanings: (a) Psychology is the scientific study of human behavior. It involves the application of scientific methods to inquire into the biological, cognitive, affective, developmental, personality, social, cultural and individual difference dimensions of human behavior. (b) Practice of Psychology consists of the delivery of psychological services that involve application of psychological principles and procedures for the purpose of describing, understanding, predicting and influencing the behavior of individuals or groups, in order to assist in the attainment of optimal human growth and functioning. The delivery of psychological services includes, but is not limited to: (1) psychological interventions: psychological counseling, psychotherapy, psychosocial support, coaching, psychological debriefing, group processes and all other psychological interventions that involve the application of psychological principles to improve psychological functioning of individuals, families, groups and organizations; (2) psychological assessment: gathering and integration of psychology-related data for the purpose of making a psychological evaluation, accomplished through a variety of tools, including individual tests, projective tests, clinical interview and other psychological assessment tools, for the purpose of assessing diverse psychological functions including cognitive abilities, aptitudes, personality characteristics, attitudes, values, interests, emotions and motivations, among others, in support of psychological counseling, psychotherapy and other psychological interventions; and (3) psychological programs: development, planning, implementation, monitoring and evaluation of psychological treatment for individuals and/or groups. (c) Psychologist means a natural person who is duly registered and holds a valid certificate of registration and a valid professional identification card as professional psychologist, issued by the Professional Regulatory Board of Psychology and the Professional Regulation Commission pursuant to this Act for the purpose of delivering the different psychological services defined in this Act. (d) Psychometrician means a natural person who holds a valid certificate of registration and a valid professional identification card as psychometrician issued by the Professional Regulatory Board of Psychology and the Professional Regulation Commission pursuant to this Act. As such, he/she shall be authorized to do any of the following: Provided, That such shall at all times be conducted under the supervision of a licensed professional psychologist: (1) administering and scoring of objective personality tests, structured personality tests, excluding projective tests and other higher level forms of psychological tests; (2) interpreting results of the same and preparing a written report on these results; and (3) conducting preparatory intake interviews of clients for psychological invention sessions. ARTICLE IV PROFESSIONAL REGULATORY BOARD OF PSYCHOLOGY Section 4. Creation and Composition of the Professional Regulatory Board of Psychology. There is hereby created a Professional Regulatory Board of Psychology, hereinafter called the Board, a collegial body under the administrative control and supervision of the Professional Regulation Commission, hereinafter referred to as the Commission, which shall be composed of a Chairperson and two (2) members appointed by the President of the Philippines from a list of three (3) nominees for each position. The list of nominees shall be submitted to the Commission by the integrated and accredited national organization of psychologists. The Board shall be organized not later than sixty (60) days from the effectivity of this Act. Section 5. Qualification of the Chairperson and the Members of the Professional Regulatory Board of Psychology. The Chairperson and members of the Board shall, at the time of their appointment and for the course of their term, possess the following qualifications: (a) A natural born citizen and resident of the Philippines; (b) At least thirty-five (35) years of age; (c) Possess good moral character; (d) Hold a doctorate degree in psychology conferred by a university, college or school in the Philippines or board duly recognized and/or accredited by   the Commission on Higher Education (CHED); (e) Have at least ten (10) years of practice in psychology and psychometrics in a duly recognized institution, clinic or center, as well as at least (5) years of teaching experience in the field of psychology; (f) Be a registered and licensed psychologists, except in the case of the first members of the Board who shall automatically be conferred a valid certificate of registration and a valid professional identification card in psychology and psychometrics upon appointment to the Board; (g) Is neither an officer, trustee nor member of the faculty of any university, college, institute or school where a regular course in psychology is offered or taught or review classes conducted and shall not have any pecuniary interest, direct or indirect, in any such institution; (h) Is not an officer, nor hold any position other than being a member of the integrated and accredited national organization of psychologists; and (i) Shall not have been convicted of any crime involving moral turpitude. Section 6. Term of Office. The members of the Board shall hold office for a term of three (3) years or until their successors shall have been appointed and duly qualified. Each member of the Board may be reappointed for one (1) full term of three (3) years. The first members of the Board shall hold office for the following terms: the Chairperson for three (3) years; one (10 member for two (2) years; and the other member for one (1) year, which shall be specified in their respective appointments. Any vacancy occurring within the term of a member shall be filled for the unexpired portion of the term only. Each member of the Board shall qualify by taking the proper oath prior to the performance of his/her duties. Section 7. Powers and Duties. The Board shall have the following powers and duties: (a) Administer and implement the provisions of this Act and promulgate as well as revise or update, as necessary, rules and regulations, resolutions and guidelines hereto: Provided, That the policies, resolutions, rules and regulations issued or promulgated by the Board shall be subject to review and approval of the Commission; (b) Supervise and monitor the registration, licensure and practice of psychologists and Psychometricians in the Philippines; (c) Administer oaths in connection with the administration of this Act; (d) Issue, and upon compliance with due process requirements, suspend or revoke, and/or reinstate, the certificate of registration and professional identification card for psychologists and psychometricians; (e) Adopt an official seal of the Board; (f) Monitor the conditions and circumstances affecting the practice of psychology and psychometrics in the Philippines and adopt such measures as may be deemed lawful and proper for the enhancement and maintenance of high professional, ethical and technical standards of the profession; (g) Issue permits to and exercise visitorial powers over agencies, institutions, associations and partnerships to verify that the persons practicing psychology and psychometrics therein are psychologists and psychometricians with valid certificates of registration and valid professional identification cards, and that they possess the necessary accreditation, skills and/or facilities to competently carry out their functions; (h) Assist the Commission in the formulation and implementation of the guidelines on continuing professional education for psychologists and psychometricians; (i) Ensure, in coordination with the CHED, that all educational institutions offering the course/program of psychology stric tly comply with the policies, standards and requirements prescribed by the CHED for such course/program, especially in the areas of administration, curriculum, faculty, library and facilities; (j) Prepare, adopt, issue and amend, in consultation with the CHED, syllabi for the licensure examination subjects; (k) Investigate and, when warranted, her administrative cases involving violations of this Act, its implementing rules and regulations as hereinafter promulgated, and any applicable code of ethics and/or code of professional standards. For this purpose, it may issue subpoena testificandum and subpoena duces tecum to secure the appearances of witnesses and the production of documents in connection therewith:Provided, That the Boards decision, resolution or orders rendered in administrative cases shall be subject to review only on appeal; and (l) Perform such other functions and duties as may be lawfully delegated to it, or as it may deem necessary to carry out the objectives of this Act. Section 8. Compensation and Allowances. The Chairperson and members of the Board shall receive the same compensation and allowances as those received by the Chairperson and members of the existing regulatory boards under the Commission, as provided in the charter of the Commission and in the General Appropriations Act. Section 9. Removal or Suspension of Members of the Professional Regulatory Board of Psychology. Any member of the Board may, upon the recommendation of the Commission, upon observance of due process and completion of the proper investigation, be suspended or removed by the President from office for cause, such as gross neglect of duty, incompetence, malpractice, behavior unbecoming of a psychology professional, immorality, unethical or dishonorable conduct, final conviction of any crime involving moral turpitude, any act of grant and corruption, and participation in the manipulation of or any dishonesty relative to the licensure examinations and/or the registration p rocess. Section 10. Administrative Supervision over the Board, Custodian of its Records, Secretariat and Support Services. The Board shall be under the administrative supervision and control of the Commission. All records of the Board, including documents relative to the licensure examinations as well as administrative and other investigative cases conducted by the Board, shall be kept in the custody of the Commission. The Commission shall designate the Secretary of the Board and shall provide the secretariat with necessary support services to effectivity implement the provisions of this Act. ARTICLE V LICENSURE EXAMINATIONS Section 11. Examinations Required. All applicants for registration to practice psychology and psychometrics shall be required to pass a licensure examination for psychologists and psychometricians to be conducted by the Board in such places and dates, and subject to such requirements prescribed by the Commission. Section 12. Qualifications of Applicants for the Licensure Examination for Psychologists. Any person may apply to take examination for registration and licensure as a psychologist after furnishing evidence satisfactory to the Board that the applicant: (a) Is a Filipino citizen, a permanent resident or a citizen of a foreign state/country which extends reciprocity to the Philippines relative to the practice of the profession; (b) Holds at least a masters degree in psychology conferred by a university, college or school in the Philippines or abroad recognized/accredited by the CHED and has obtained sufficient credits for the subjects covered in the examinations; (c) Has undergone a minimum of two hundred (200) hours of supervised practicum/internship/clinical experience related to services enumerated in paragraph (b) of Section 3 of this Act and under the auspices of a licensed psychologist or other licensed mental health professional; (d) Is of good moral character; and (e) Has not been convicted of an offense involving moral turpitude. Section 13. Qualifications of Applicants for the Licensure Examination for Psychometricians. Any person may apply to take the examination for registration and licensure as a psychometrician by furnishing evidence satisfactory to the Board that the applicant: (a) Is a Filipino citizen, a permanent resident or a citizen of a foreign state/country which extends reciprocity to the Philippines relative to the practice of the profession; (b) Holds at least a bachelors degree in psychology conferred by a university, college or school in the Philippines or abroad recognized/accredited by the CHED and has obtained sufficient credits for the subjects covered in the examinations; (c) Is of good moral character; and (d) Has not been convicted of an offense involving moral turpitude. Section 14. Examination Subjects for Psychologists. The licensure examination for psychologists shall cover the following subjects: (a) Advanced Theories of Personality; (b) Advanced Abnormal Psychology; (c) Advanced Psychological Assessment; and (d) Psychological Counseling and Psychotherapy. Section 15. Examination Subjects for Psychometricians. The licensure examinations for psychometricians shall cover the following subjects: (a) Theories of Personality; (b) Abnormal Psychology; (c) Industrial Psychology; and (d) Psychological Assessment. The Board may recluster, rearrange, modify, add or exclude and prescribed subjects for psychologists and psychometricians as the need arises. Section 16. Registration Without Examination for Psychologists. A person who possesses the qualifications required to take the examination for registration as a psychologist pursuant to the provisions of this Act may be registered without examination: Provided, That the applicant files with the Board within three (3) years after its creation an application for registration and issuance of certificate of registration and professional identification card by submitting credentials satisfactory to the Board that the applicant had, on or prior to the effectivity of this Act, fulfilled the requirements under either subparagraphs (a), (b) or (c) herein: (a) Obtained a doctoral degree in psychology and had accumulated three (3) years of work experience in the practice of psychology; (b) Obtained a masters degree in psychology and accumulated a minimum of five (5) years of work experience in the practice of psychology; (c) Psychologists or employees who hold positions as psychologists presently employed in various government or private agencies, who have a bachelors degree in psychology, accumulated a minimum of ten (10) years of work experience in the practice of psychology as a psychologist, and who have updated their professional education in various psychology-related functions. Section 17. Registration Without Examination for Psychometricians. A person who possesses the qualifications required to take the examination for registration as a psychometrician may be registered without examination:Provided, That the applicant files with the Board within three (3) years after its creation an application for registration and issuance of a certificate of registration and professional identification card by submitting credentials satisfactory to the Board that the applicant before the effectivity of this Act had obtained a bachelors degree in psychology and had accumulated a minimum of two (2) years fu ll time work experience in the practice of psychometrics. Section 18. Ratings in the Examination. To be qualified as having passed the licensure examination for psychologists and psychometricians, a candidate must have obtained a weighted general average of at least seventy-five percent (75%) for all subjects, with no grade lower than sixty percent (60%) in any given subject. An examine who obtains a weighted general average of seventy-five percent (75%) or higher but obtains a rating below sixty percent (60%) in any given subject may retake such subjects within the next two (2) years, and upon obtaining a rating of at least seventy-five percent (75%) in each such subject, shall then be deemed to have passed the licensure examination. Section 19. Report of Ratings. The Board shall submit to the Commission an official report detailing the ratings obtained by each examine within ten (10) calendar days after the examination, unless such period is extended for just cause. ARTICLE VI REGISTRATION Section 20. Oath of Psychologists and Psychometricians. All successful examines qualified for registration and all qualified applicants for registration without examination shall be required to take an oath to uphold the profession before any member of the Board or any officer of the Commission authorized to administer oaths, prior to entering into the practice of psychology or psychometrics in the Philippines. Section 21. Issuance of Certificate of Registration and Professional Identification Card. A certificate of registration and professional identification card shall be issued to all successful examines and registrants without examination upon compliance with all the legal requirements, including payment of fees, prescribed by the Commission. The certificate of registration shall bear the signature of the Chairperson of the Commission and members of the Board, indicating that the person named therein is entitled to practice the profession with all the privileges and concomitant responsibilities appurtenant thereto. The said certificate shall remain in full force and effect until suspended in accordance with this Act. A professional identification card bearing the registration number, date of issuance and validity term of three (3) years, duly signed by the Chairperson of the Commission, shall likewise be issued to every registrant who has paid the prescribed registration fee. Upon expiration of the professional identification card, the psychologist and psychometrician may renew the same upon proof of compliance with continuing education requirements prescribed by the Board and/or the Commission. Section 22. Disclosure of Registration Information. The psychologist or psychomitrician shall be required to indicate his/her registration and professional identification card number and date of issuance, the duration of validity, including the professional tax receipt number on each document signed, used or issued in connection with the practice of his/her profession. Section 23. Non-issuance of Certificate of Registration and Professional Identification Card. The Board shall not register nor issue a certificate of registration or professional identification card to any person convicted of a criminal offense involving moral turpitude, has been found guilty by a judicial or other duly constituted tribunal of immoral or dishonorable conduct, or has been medically diagnosed to be of unsound mind. In the event of non-issuance of the certificate for any reason, the Board shall furnish the applicant a written statement setting forth the reasons for such denial, which statement shall be incorporated to the records of the Board. Section 24. Foreign Reciprocity. No foreigner shall be admitted to the psychology or psychometrics licensure examinations unless he/she proves that the country of which he/she is a citizen either: (a) Admits Filipino citizens to the practice of psychology or psychometrics without need for registration and issuance of a certificate of registration/professional identification card; (b) Allows Filipino citizens to practice psychology or psychometrics without restriction; or (c) Allows Filipino citizens to practice the same after an examination on terms of strict and absolute equality with nationals of said country. Section 25. Practice through Special/Temporary Permit. Special/temporary permits may be issued by the Board, subject to the approval by the Commission and payment of appropriate fees, to the following persons: (a) Licensed psychologists or psychometricians from foreign countries/states who are internationally acknowledged specialists or outstanding experts in psychology or psychometrics: Provided, That their services are important and necessary either due to the lack or inadequacy of available local specialists or experts or in recognition of their potential contribution to the promotion and advancement of the practice of psychology of psychometrics through transfer of technology; (b) Licensed psychologists or psychometricians from foreign countries/states whose services shall be free and offered exclusively to indigent patients in a particular hospital, center or clinic; and (c) Licensed psychologists or psychometricians from foreign countries/states employed as exchange professors to teach psychology or psychometrics in schools, colle ges, universities offering psychology or psychometrics courses or programs. The permit shall detail the conditions thereof which shall, among other things, include the effectivity period of not more than one (1) year subject to renewal and the specific place of practice such as the clinic, hospital, center, school, college, university offering the course of psychology or psychometrics. The Board, subject to the approval by the Commission, shall prescribed rules and regulations on the implementation of this particular section. Section 26. Suspension or Revocation of Certificate of Registration and Professional Identification Card or Cancellation of a Special/Temporary Permit. The Board shall have the power, after notice and hearing, to suspend or revoke the certificate of registration and professional identification card or to cancel special/temporary permits granted pursuant to this Act on any ground set forth in Section 33 of this Act or any of the instances hereunder: (a) Procurement of a certificate of registration and/or professional identification card or special/temporary permit by fraud or deceit; (b) Allowing an unqualified person to advertise or to practice the profession by using ones certificate of registration or professional identification card or special/temporary permit; (c) Violating or conspiring to violate any of the provisions of this Act, its implementing rules and regulations, the code of ethics or code of professional standards promulgated hereinafter by the Board; (d) Manifest physical or mental incompetence to render psychological services with reasonable skill and safety to his/her clients/patients; (e) Professional misconduct or negligence in the performance of duties as a psychometrician; and (f) Engaging in the practice of the profession during the period of ones suspension. Section 27. Reinstatement. A psychologist or psychometrician whose certificate of registration has been revoked may apply to the Board for reinstatement at any time after two (2) years from the date of revocation of said certificate. The application shall be in writing and shall conform to requirements hereinafter prescribed by the Board. No certificate of registration or professional identification card or special/temporary permit shall be reinstated unless the Board is satisfied that a good cause exists to warrant such reinstatement. Issuance of a new certificate of registration or professional identification card or special/temporary permit in lieu of one that has been lost, destroyed or mutilated shall be subject to applicable rules prescribed by the Commission. Section 28. Appeal from Judgement. The decision of the Board shall ipso facto become final fifteen (15) days from receipt of the decision by the respondent unless an appeal has been filed with the Commission within the same period. The Commissions decision on appeal may be further appealed before the Court Appeals within fifteen (15) days from receipt thereof. Section 29. Rights of the Respondent. The respondent psychologist or psychometrician shall have the right to be represented by counsel at all stages of the proceedings as well as to speedy disposition of his/her case. He/She shall have the right to confront witnesses against him/her in addition to such other rights guaranteed by the Constitution. ARTICLE VII PRIVILEDGED COMMUNICATION AND PROFESSIONAL INTEGRATION Section 30. Rights to Privilege Communication for Psychologists and Psychometricians. A psychologists or psychometrician cannot, without the consent of the client/patient, be examined on any communication or information disclosed and/or acquired in the course of giving psychological services to such client. The protection accorded herein shall extend to all pertinent records and shall be available to the secretary, clerk or other staff of the licensed psychologist or psychometrician. Any evidence obtained in violation of this provision shall be inadmissible for any purpose in any proceeding. Section 31. Integration of the Profession. The profession shall hereinafter be integrated by consolidating all practitioners into one (1) national organization of registered and licensed psychologists and psychometricians, which shall be recognized and accredited by the Board, subject to approval of the Commission. A psychologist or psychometrician duly registered and licensed by the Board and the Commission shall automatically become a member of said organization and shall receive the benefits and privileges, as well as be subject to all responsibilities and obligations, appurtenant thereto upon payment of the required fees and dues. Membership in the integrated organization shall not be a bar to membership in any other association of psychologists and/or psychometricians.1avvphi1 Section 32. Code of Ethics and Code of Practice for Psychologists and Psychometricians. The Board shall adopt and promulgated the Code of Ethics and Code of Practice for Psychometricians prescribed and issued by the accredited professional organi zation of psychologists. ARTICLE VIII PROHIBITED ACTS, PENALTIES AND ENFORCEMENT OF THIS ACT Section 33. Prohibited Acts. (a) No person shall: (1) Engage in the professional practice of psychology or psychometrics nor represent himself/herself as a professional practicing psychologist or psychometrician without a valid certificate of registration or valid professional identification card, or a valid special/temporary permit granted by the Board pursuant to this Act; (2) Represent himself/herself to be a licensed and authorized practicing psychologist or psychometrician during the time that his/her certificate of registration has been suspended or revoked or professional identification card without being renewed, or special/temporary permit cancelled; (3) Allow any other person to use his/her certificate of registration and professional identification card or special/temporary permit for any purpose, regardless of whether such enables the unqualified individual to engage in the practice of psychology or psychometrics; (4) Use, exhibit and/or misrepresent as his/her own the certificate of registration and/or professional iden tification card or special/temporary permit of another; and (5) Give any false, inaccurate, misleading or incomplete information to the Board on order to obtain a certificate of registration or professional identification card or special/temporary permit. (b) No corporation, partnership, association or entity shall operate a psychology or psychometrics office, center, clinic or otherwise engage in the practice or allow the practice of psychology or psychometrics within its premises without securing a permit therefor from the Board. Such permit shall be issued only after the Board is satisfied that such establishment is competently staffed by a psychologist and equipped with sufficient and adequate psychology-related instruments and facilities. (c)A violation of any provision of this Act or of its implementing rules and regulations shall be penalized accordingly. Section 34. Penalties. Any person who violates any provision of this Act implementing rules and regulations shall be punished with imprisonment of not less than six (6) months but not more than three (3) years, or a fine of not less than Ten thousand pesos (P10,000.00) but not more than One hundred thousand pesos (P100,000.00), or both, at the discretion of the court. Section 35. Injunction. The Board may initiate action to enjoin, restrain, and/or prosecute any individual, corporation, association, partnership or entity engaging in the practice of psychology and psychometrics in violation of this Act. Section 36. Enforcement. It shall be the duty of all duly constituted law enforcement agencies and officers of national, provincial, city or municipal governments to uphold and enforce the provisions of this Act and to investigate and prosecute or cause the investigation and prosecution of any person violating the same. ARTICLE IX MISCELLANEOUS PROVISIONS Section 37. Funding Provision. The Chairperson of the Commission shall immediately hereinafter include in the Commissions programs the prompt implementation of this Act, funding of which shall be provided for in the annual General Appropriations Act. Section 38. Implementing Rules and Regulations. Within ninety (90) days after the constitution of the Board, it shall promulgated the necessary implementing rules and regulations, subject to approval of the Commission, to implement the provisions of this Act. Section 39. Separability Clause. If any provision of this Act shall at any time be found to be unconstitutional or invalid, the remainder thereof not affected by such declaration shall remain in full force and effect. Section 40. Repealing Clause. All laws, decrees, rules or regulations inconsistent with the provisions of this Act are hereby repealed or modified accordingly. Section 41. Effectivity. Effect of Government Debt on Incentives for Money Creation Abdullahi Ahmad Why might the level of government debt affect the government incentive regarding to money creation. Government debt (also known as public debt and national debt) is the debt owed by a central government. Government debt is one method of financing government operations, but it is not the only method. Governments can also create money to monetize their debts, thereby removing the need to pay interest. But this practice simply reduces government interest costs rather than truly cancelling government debt, and can result in hyperinflation if used unsparingly. Public debt is one result of government financing expenditures. It is different from private debt, which consists of the obligations of individuals, businesses, and nongovernmental organizations. Public debt comes about as a result of taxing and borrowing by the federal government. The U.S. government has large capital outlays for such purposes as building or improving schools, hospitals, and highways. In order to pay for these projects, the government must finance part of their expenditures. When a government borrows money it als o avoids the excessive tax burden that such payments would involve in a single tax period. Public borrowing is generally believed to have an inflationary effect on the economy and for that reason is often resorted to in recessionary periods to stimulate investment, employment, and consumption. The debt owed by national governments is usually referred to as the national debt and is thus distinguished from the public debt of state and local governing bodies. In the United States, bonds issued by states and local governments are known as municipals. In the past, paper money was frequently regarded as a portion of the public debt, but in more recent years money has been regarded as a distinct type of obligation, in part because it is usually no longer payable in gold, silver, or other specific items of intrinsic value. Public debt, which is also sometimes referred to as government debt, is all of the money owed at any given time by any branch of the government. It encompasses debt owed by the federal government, the state government, and even the municipal and local government. It is, in effect, an extension of personal debt, since individuals make up the revenue stream of the government. Public debt accrues over time when the government spends more money than it collects in taxation. As a government engages in more deficit spending, the amount of debt increases. Many different types of debt make up public debt. A great deal of it is external debt, which is money that is owed by the government to foreign lenders, either in the form of international organizations, other governments, or groups like sovereign wealth funds, which invest in government bonds. Government debt is also made up of internal debt, where citizens and groups within the country lend the government money to continue operating. In some ways, this is a lot like lending to oneself, since ultimately the responsibility for it falls back on the very people lending money. Government incentive simply means something that motivates an individual to perform an action. The study of incentive structures is central to the study of all economic activities (both in terms of individual decision-making and in terms of cooperation and competition within a larger institutional structure). Economic analysis, then, of the differences between societies (and between different organizations within a society) largely amounts to characterizing the differences in incentive structures faced by individuals involved in these collective efforts. Ultimately, incentives aim to provide value for money and contribute to organizational success. incentive is not peculiar to economics alone, it is a general term used in many spheres of life. However, in economics, it is a very important word. In fact you can never study economics successfully without understanding what incentives are. One American economist says that economics in its entirety is a study of people’s response to incentives. Whether that statement is accurate or not is subject to one’s point of view, but what comes out clearly is the fact that incentives are truly central to the study of economics. In economics one can say that an incentive is a benefit, reward, or cost that motivates an economic action. Human beings do things deliberately and purposefully, and, naturally, people expect to benefit from their own decisions and actions. Before someone decides to produce something and sell it to people, they should have taken time to think and decide that doing this will help them earn something. Likewise, before a consumer buys anything, they know (or at least they think) that they are going to benefit from the product. In strict sense, it is more than just the usual concepts or trade and economics, it is about human nature. No one does something for no reason. Not when they have to spend time and resources in doing so. Incentives can be grouped into four main categories, or types. T hese types of incentives apply both to economics and to other spheres of life. These are as follows, Financial incentives: Perhaps in the modern times, financial incentives are more dominant. Before you get to business, you know that it is always about profit. Employment is all about salary and remuneration. It is true that sometimes people do voluntary jobs for some reasons other than financial ones. But ultimately, the main reason why human beings do business or work at all in modern days is money. It is this type of incentive that informs the idea of product promotions, where people are told that if they buy a certain product; they stand a chance of winning a certain amount of money. Moral incentives: Moral incentives motivate people to do things on the basis of right and wrong. People are encouraged to do certain action because morally, it is the right thing to do. Aspects of morality today are quite diverse, varying broadly from one society to the next, and it is practically impossible to define morals of society in general. Moral incentives therefore generally appeal to an individual’s own conscience. Natural incentives: â€Å"What will happen if I do this?† We often ask ourselves. Humans are naturally curious creatures, and we do many things for no reason other than to find out what the consequences are. Coercive incentives: Moral incentives motivate people to do things on the basis of right and wrong. People are encouraged to do certain action because morally, it is the right thing to do. Aspects of morality today are quite diverse, varying broadly from one society to the next, and it is practically impossible to define morals of society in general. Moral incentives therefore generally appeal to an individual’s own conscience. In economics, money creation is the process by which the of a country is increased. A central bank may introduce new money into the economy (termed expansionary monetary policy) by purchasing financial assets or lending money to financial institutions. Commercial bank lending then multiplies this base money through fractional reserve banking, which expands the total of broad money (cash plus demand deposits). Also money creation is The process in which banks increase the amount of funds in checkable deposits by using reserves to make loans. Money creation is an important process in the economy because it means that the government does not have total control over the money supply. In view of the above definition there is a high link between debt and money creation. Therefore, the monetary authority of a nation which is usually the Central Bank helps to effectively creates money by implementing policy through its Open Market Operation. To create money, the Central Bank simply buys government securities such as Treasury Bills, Treasury Certificates and Treasury Bonds from participating banking institutions. All these Treasury securities are bought in the Open Market. These treasury certificates are exchange for money which the commercial bank will have in their possession to give as loans to members of the public and it tends to increase bank credit. Thus, stimulating money creation. However, money creation could be restricted as government debt increases which could either be as a result of necessity or deliberate, if government as a result of necessity want to borrow money it usually does these through the treasury department under the Central Bank. There for the Treasury Department of a nation, in order to raise cash, will print up a stack of Treasury bonds, which are the means by which the government borrows money, these government debt tends to mop up the supply of money in private banks as central bank do not deal directly with members of the public and thus reducing the ability of commercial bank to lend money. The supply of money could also be restricted by government deliberately by selling treasury certificate at an attractive interest thus limiting the commercial bank ability to give loans and thus create money. It should be interesting to know that the money created by the government is also created through debt because as it is the money used in buying treasury certificates was a result of monetizing of debt because the money created out of thin air by the Central Bank on behalf of government is a promise to pay without attracting interest. Hence debt is use to pay debt. In this case debt without obligation is used to pay debt with obligation. Invariably money could be created through debt and as well restricted through debt; it all depends on which form of debt government is using. If government uses debt with obligations, that is when government sells treasury certificates to raise cash and thus restrict the ability of commercial bank to create money. If however, government uses debt without obligation, that is when the government print money to buy treasury securities and as such enable the commercial bank to increase their lending power. This brings more money to the economy because the commercial bank will be able to give out more loans from the money received from the sale of treasury securities. So now we know that there are two kinds of money out there. The first is bank credit, which is money that is loaned into existence, as we saw here. Bank credit is a type of money that comes with an equal and offsetting amount of debt associated with it. Debt upon which interest must be paid. The first is that all cash or money of a nation are backed by debt. At the local bank level, all new money is loaned into existence. At the Federal Reserve level, money is simply manufactured out of thin air and then exchanged for interest-paying government debt. In both cases, the money is backed by debt. Debt that pays interest. From this Key Concept, we can formulate a truly profound statement, which is that at a minimum, each year enough new money must be loaned into existence to cover the interest payments on all of the past outstanding debt. If we flip this slightly, we can say that each year all the outstanding debt must compound by at least the rate of the interest on that debt. Each and every year it must grow by some percentage. Because our debt-based money system is growing by some percentage continually, it is an exponential system by its very design. A corollary of this is that the amount of debt in the system will always exceed the amount of money. By understanding its design, though, one will be better equipped to understand that the potential range of future outcomes for our economy are not limitless, but rather bounded by the rules of the system. All of which leads us to the fact that perpetual expansion is a requirement of modern banking. In fact we can make a rule: Each year, new credit (loans) must be made that at least equal the amount of all the outstanding interest payments that year. Without a continuous expansion of the money supply, past debts would not be able to be serviced, and defaults would ripple through, and possibly destroy, the entire system. Defaults are the Achilles heel of a debt-based money system, which we saw in our local banking example in the previous chapter. Because of this, all the institutional and political forces in our society are geared towards avoiding this outcome. In view of the above money, government debt will help stimulate money creation if only there is more debt without obligation by government as against government debt with obligation. Conclusively, debt is money.

My Philosophy Everyday we learn, whether we are conscious of it or not. Since primate times to the new generations. Primates taught their kids how to hunt, those kids taught the next generation, and the chain of teaching still exists because we still learn new data, and information every day in our lives. We gain this new information primarily from our parents and teachers. I thank God for all the people who had taught me the things that I know, and helped me to realize that education is a necessity in my life. Education is a necessity in our lives. We need to go to school to become well prepare persons in the future. If I did not have the education I have today, probably I would be working at a Jack in the Box fast food restaurant, or at Wal-Mart. I am not saying that these work places are not dignify, but I would not had the benefits I have, and all the knowledge I have conquer through out the years of education, and experience. Becoming a teacher is one of the greatest experiences in my life. I will confess, teaching was not in my plans, but Gadsden School District gave me the opportunity to become a music teacher. In the district, I found out that becoming an educator is not about money, vacation, or sick leaves. This profession has to do with the satisfaction of seeing your kids accomplish their dreams, and goals. We all have experience these wonderful school satisfactions, through kindergarten, all the way to University. I remember when I f irst wrote my name in a piece of paper, I was all happy because of what I have accomplished. Since then, I have achieved many goals, and dreams. Now, I have realized that I am giving the same educational opportunities to f ind fulfillment to my music students. This fulfillment is visible when I teach them a new rhythm, or a new song. Like myself, my music students walk out of my classroom happy, and proud due to the new knowledge they have accomplish. On the other hand, I could not have achieved these goals and dreams without the help of all my professors. In all the years I have been going to school, many teachers are still in my mind.

You are not the only one, our society is depending on an omnipresent source of technology that is affecting every moment of our lives. We are using it as a way to deliver and receive information, to entertain ourselves and express our individuality. It has been growing exponentially since the dawn of time to fulfill humanity’s aspiration. Although, for the new generations, it as been affecting them negatively in crucial aspects of their lives. The lack of physical activities is the number one cause of overweight and obesity for teenagers. Research as proved that, â€Å"For adolescents aged 12 to 17, increases in overweight and obesity rates over the past 25 years have been notable; the overweight or obesity rate of this age group more than doubled, and the obesity rate tripled† (Margot Shileds, 2008, p.2). Of course, technologies might not be the only source of this issue but consider this, â€Å"For children aged 6 to 11 and adolescents aged 12 to 17, the likelihood of being overweight or obese tends to rise as time spent watching TV, playing video games or using the computer increases†. In addition, â€Å"According to research, playing video games accelerates the speed at which dopamine, believed â€Å"reinforce behavior that produces pleasure,† is produced. Was Darwin Wrong?

{draw:g} {draw:g} {draw:g} Table of Contents Introduction Who was Charles Darwin? Charles Darwin was born in 1809 in Shrewsbury, England. Originally, Darwin did not believe in the idea of evolution and trained to be a priest before studying geology and biology. In 1831, when Darwin was 22, he set sail around the world on HMS Beagle, a naval survey ship. The trip lasted for 5 years during which time the ship stopped at many places including the Galapagos Islands, just off the west coast of South America. Darwin examined animals and plants from everywhere he visited, taking specimens back to England and recording his observations in a diary. However he was most intrigued by the finches on the Galapagos Islands†¦ What was Darwin’s Theory of Natural Selection? {draw:frame} Darwin noticed that there were wide variations in the finches’ size, beaks and claws. He decided the beaks were designed for eating different things and concluded that the finches must have evolved from just one species which had changed over time. They had adapted to their surroundings. In order to begin to understand natural selection, it is important recognise how the many hundreds of thousands of living organisms are classified. The diagram on the next page shows an example of how we determine a species. {draw:frame} {draw:rect} A species can be defined as a group of organisms so similar they can breed together to form fertile offspring. For example, a horse and a donkey can breed to produce a mule but the mule, is infertile therefore showing a horse and a donkey are of different species. Within a species there are still differences and this variation is very important in evolution because without them, natural selection could not occur. Variation can be either genetic, environmental or a combination of both. For example: Variation caused by genes includes eye colour , gender Variation caused by the environment includes accent Variation caused by a combination of both includes high blood pressure, weight Nearly all variation is caused by a combination of these factors. Many people before Darwin thought about evolution and most scientists agreed that life on earth started from a few, simple living things. Alfred Russel Wallace and Jean Baptiste de Lamarck both had ideas about evolution, but Darwin was the first to come up with a plausible idea of how evolution happened. This is what he called Natural Selection and when he returned from his round the world trip, Darwin spent over twenty years working to prove his theory. Wallace wrote to him asking him for advice and together they wrote a paper about evolution. To summarize, Darwin’s theory is basically: Species change over time. This is supported by the fossil record. All organisms share a common ancestor which explains the similarities between organisms that are classified together. This is supported by evidence of vestigial organs and homologous structures (see page 6). Evolutionary change is gradual and slow. This is also supported by the fossil record. Another crucial conclusion Darwin made, was that there are always going to be too many of one species for each of them to survive. This is because they will always be in competition for food and space. He established that those best suited to survive pass their genes onto their offspring, which causes their species to change over time and could lead to their extinction. {draw:frame} {draw:frame} {draw:rect} {draw:frame} {draw:rect} {draw:rect} {draw:frame} {draw:frame} {draw:rect} Diagram to show the steps in natural selection Why the population of a species changes over time {draw:frame} In the above graph, the Canadian lynx eats the Snowshoe hare. No other cat is so dependent on a single prey species. Two years after a rise in the snowshoe hare population, there is a rise in the lynx population. Then, the Snowshoe hare population falls. When there are too few Snowshoe hares for the lynx to survive, their population starts to fall as well. Because the predator population has now decreased, it allows time for the prey population to increase again. As there is now more food, the predator population starts to increase again. This cycle repeats itself over and over. That is why we say there is a clear pattern of interdependence between the two populations. What Evidence did Darwin Use? Fossil Record A fossil is a dead plant, animal or other once-living thing that has been preserved for millions of years and leaves an imprint in stone. Almost all fossils are from extinct species. Darwin used fossils to prove that evolution happened. He could determine the relative age of various fossils by looking at the layers in the rock and he could see the changes in one type of fossil. For example, by collecting many fossils of one animal, he could see how it had evolved over time. An animal may become extinct when there is a sudden change in their habitat – for example food or temperature. A new species can become either the predator or the prey of a species already living there, thus placing either species under possible threat of extinction. The extinction of a species has an effect on the food chain. Limitations of the Fossil Record There are gaps in the fossil record because the conditions were not always suitable for fossils to develop. This meant that not every species was recorded as a fossil and sometimes a species would occur that had no link to a previous one. Also, because evolution happens over a long period of time and often in sudden bursts, (these bursts could be up to 10,000 years apart) evidence of smaller changes were not recorded. Vestigial Organs A vestigial organ is one that has little or no use now, but was well developed in its ancestors – exactly like our appendix. By looking at vestigial organs in modern species and seeing if older species had used that organ, Darwin could determine how a species had changed over time. Homologous Structures Darwin also compared homologous structures which are body parts that structurally similar in related species. If two or more different species have homologous structures, it shows that they have come from the same origin. For example, gorillas and homo-sapiens both have similar body features (hand, skulls†¦ ) illustrating that the two species have the same ancestors. Was Darwin’s theory accepted at the time? Darwin’s theory was widely rejected at the time because many people were creationists. This means they believe the creation story in the bible i. e. ll life was created in six days. Darwin’s theory of evolution challenged this view, but because there were gaps in the fossil record, it was hardto trace the changes in a species and convincing people, therefore was very difficult. Also, the age of the earth was estimated by using the Bible to be about 6000 years old, but this did not seem long enough for evolution to have taken place. Finally, although Darwin knew certain features were passed on from generation to generation, he could not explain why (see later). What other theories were there? Lamarck’s theory Lamarck had a different theory. He believed that by striving to fit into their surroundings, the animal’s bodies changed. According to his theory, the giraffe developed its long neck by stretching it to reach the leaves on trees. Similar to other scientists he explained that life started with simple living things. However, he believed that at each generation, they became more complicated. His theory did not take account of the single celled life that still existed on Earth. Lamarck could see the changes in a species, but tried to explain it in a different way because he was afraid that people would not support the idea of natural selection. Mendel’s theory George Mendel was born in 1822. Because he was poor, he joined a monastery, but also studied at the University of Vienna where he learned to carry out scientific experiments. At the monastery he learned how to breed plants and one of his jobs was to create better varieties. He was very interested in how features were passed on from one generation to the next and he decided to crossbreed different pea plants to see what would happen. He crossed red flowered plants with white and the resulting plants were all red. He then bred these plants together and this experiment returned mostly red but some white. Mendel concluded that there must be different versions of the same genes. What evidence has been obtained since Darwin? Peppered Moths – Kettlewell studies of the 1950’s During the industrial revolution, carbon (soot) coated trees in a dark colour. The once dominant and well camouflaged pale moths (typica) were now being replaced by the rarer darker moths (carbonaria). These moths continued grow in numbers and by 1895 they represented 98% of all moths in Manchester. Naturalists at this time suggested this was a result of the industrial activity on the local landscape and that the darker moths had a survival advantage. They had become so well camouflaged on trees they had stopped being eaten by birds, whereas the paler, typica species had now become clearly visible. The general population had changed from the pale coloured moth, to the darker coloured moth and this was another example of natural selection. In 1998, a scientist called Michael Majerus re-examined Kettlewell’s studies and concluded that the colour change in the moths is an example of natural selection, but predation by birds is only one factor – not the sole factor. DNA (Deoxyribonucleic Acid) and Genetics Francis Crick, a scientist from Cambridge announced in 1953, he and James Watson had found the â€Å"secret of life† – the structure of D. N. A. D. N. A. is the material inside the nucleus of cells and carries the information of how organisms develop. It is copied when new cells are made, but can be damaged or changed, usually resulting in the death of the cell. Genes are passed on from parents to offspring ensuring that the most successful individuals survive. Variation is caused because of differences in genes. Bacterial antibiotic resistance Sometimes a mutation in D. N. A. can be beneficial for the bacteria. For example bacteria can become resistant to antibiotics and this gives them an added advantage over non-resistant bacteria. Why I think that new evidence will continue support Darwin’s theory I think that new evidence will continue to support Darwin’s theory for a number of reasons: Advances in technology mean newer ways of discovering the past will become available As species evolve further, scientists will have etter records to get information from Now scientists know what they are looking for which provides evidence of evolution Overall, I agree with the scientific belief today that â€Å"natural selection is the mechanism which leads to adaption and diversity† whilst â€Å"genetics provide the mechanics for traits to be inherited† Bibliography
